Welcome to Etched & Inked Creative Studio. Throughout these Terms, the terms “we,” “us,” and “our” refer to Etched & Inked Creative Studio. We operate this website and online store, including all related information, content, features, tools, products, and services made available to you through our Shopify-powered storefront.

These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By visiting our site, browsing, purchasing from us, or otherwise using our services, you agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy, and Returns, Refunds, and Exchanges Policy, which are incorporated into these Terms by reference.

1. Online Store Use

2. Products and Services

Etched & Inked Creative Studio may offer a variety of products, including but not limited to:

custom and personalized binders
made-to-order in-house design products
ready-to-ship stickers
stationery
accessories
other current or future product offerings

We reserve the right to modify, discontinue, or limit the availability of any product or service at any time without notice.

We make every effort to display product descriptions, photos, colors, and design details as accurately as possible. However, we cannot guarantee that your device’s display will reflect product colors, finishes, or details exactly as they appear in person.

3. Custom and Made-to-Order Products

Many of our products are made to order or personalized specifically for the customer. By placing an order for a custom or made-to-order item, you acknowledge and agree that production timelines, design approvals, and refund eligibility may differ from ready-to-ship merchandise.

For custom orders, customers are responsible for reviewing any proof, mockup, or approval image we provide before production begins. Once a custom design is approved and production begins, the order cannot be canceled, refunded, or exchanged except as required by law or as otherwise stated in our posted store policies.

4. Orders and Acceptance

Placing an order through our website constitutes an offer to purchase. We reserve the right to accept, decline, cancel, or limit any order at our discretion, including for reasons such as product availability, suspected fraud, pricing errors, inaccurate product information, or issues with payment or shipping details.

You are responsible for reviewing your order carefully before submitting it. If we need to cancel or modify an order, we will attempt to contact you using the contact information provided at checkout.

5. Prices, Billing, and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices, discounts, and promotions are subject to change without notice.

You agree to provide current, complete, and accurate billing, payment, and shipping information for all purchases made through our store. By submitting payment information, you represent that you are authorized to use the selected payment method and that all information provided is accurate.

Applicable taxes, shipping costs, and other charges will be calculated at checkout where applicable.

6. Shipping and Fulfillment

All orders are processed according to the product type purchased.

Made-to-order in-house design items typically ship within 10 business days.
Custom, one-of-a-kind, or personalized items may take up to 30 business days to complete and ship.
Ready-to-ship items, such as stickers or select accessories, will typically ship within the timeframe stated in the product listing or within a reasonable processing period unless otherwise noted.

Production times and shipping transit times are separate. Delivery estimates provided at checkout or by the carrier do not include production time.

We are not responsible for delays caused by shipping carriers, weather, supply issues, customs, holidays, or other circumstances outside of our control.

Customers are responsible for entering a complete and accurate shipping address at checkout. We are not responsible for delays, failed deliveries, or lost packages caused by incorrect or incomplete address information provided by the customer.

Once a package has been marked as delivered by the shipping carrier, including USPS, UPS, or FedEx, we are not liable for package theft, loss, or misdelivery after that delivery confirmation.

If your order arrives damaged, incorrect, or materially different from what was ordered, please contact us at etched.inked.creative@gmail.com within 5 days of delivery and include your order number and clear photos of the item and packaging.

7. Returns, Refunds, and Exchanges

Because our shop offers a mix of custom, made-to-order, and ready-to-ship products, return and refund eligibility varies by item type.

Custom and Personalized Items

Custom and personalized items, including custom binder orders and other one-of-a-kind products made specifically for the customer, are final sale. These items are not eligible for returns, refunds, or exchanges once production has begun.

Cancellation requests for custom orders may be considered only before shipment and before the order has entered final production processing. If approved, the order will be refunded to the original form of payment, minus a 3% cancellation fee to cover non-refundable payment processing charges.

Once a custom or personalized item has been approved for production, completed, or shipped, it is no longer eligible for cancellation, refund, or exchange.

Made-to-Order In-House Designs

Made-to-order items featuring our in-house designs are generally final sale due to their made-to-order nature. These items are not eligible for refunds, returns, or exchanges unless they arrive damaged or materially different from what was ordered.

Ready-to-Ship Items

Eligible ready-to-ship items, including select stickers, accessories, stationery, or other small goods, may be approved for return or exchange on a case-by-case basis if they are unused, unopened, and in original condition. Requests must be made within 5 days of delivery. Return shipping costs are the responsibility of the customer unless the item arrived damaged or incorrect.

8. Product Descriptions and Availability

We reserve the right to update product descriptions, pricing, availability, specifications, and product offerings at any time without notice. We also reserve the right to discontinue any product at any time.

We do not guarantee that all products, services, or materials described on the site will always be available.

9. Intellectual Property

All content on this website, including but not limited to text, graphics, images, logos, product designs, design names, descriptions, branding, videos, and site layout, is the property of Etched & Inked Creative Studio or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, copy, display, publish, sell, or exploit any portion of our website or content without our prior written permission.

10. Third-Party Services and Links

Our site may include access to third-party tools, integrations, services, or links to third-party websites. These are provided for convenience only.

We do not control and are not responsible for third-party websites, services, content, privacy practices, or policies. Your use of any third-party services is at your own risk and subject to the terms of those third parties.

11. Shopify Platform Relationship

Our store is powered by Shopify, which enables us to provide our online storefront and e-commerce services to you. However, all purchases made through this store are made directly with Etched & Inked Creative Studio, not with Shopify.

You acknowledge and agree that Shopify is not responsible for any aspect of any sales, customer service issues, product issues, shipping issues, or disputes between you and Etched & Inked Creative Studio.

12. User Submissions and Feedback

If you submit reviews, comments, ideas, suggestions, feedback, photos, or other content to us, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, publish, display, and share that content for business, promotional, or marketing purposes, unless otherwise prohibited by law.

You represent that any content you submit is accurate, lawful, and does not violate the rights of any third party.

We reserve the right, but are not obligated, to remove content that we determine to be unlawful, offensive, misleading, defamatory, infringing, or otherwise inappropriate.
